Valentine Michaud: Yes, but if BOTH parties agree to dissolve the marriage, it is easier. In the situation you describe, the divorce would be a contested divorce - in which one party does not agree to dissolve the marriage. But yes, the divorce will still happen, but it will be settled in a courtroom instead of among the two parties and their attorney's.

Raye Tredennick: I am quite sure that they could my reason for saying this is that a Court could not go against the notion of free will to choose to leave a marriage. They may request counselling before a decision is made especially if there are children involved or it is a long term relationship.Interesting question, have you Googled it?Cheers
